HayInsights Terms of Use

1. Information and investment notice

  All information, data, articles, charts and other materials on the Services are provided for reference only. Much of the data comes from third-party sources. We do not guarantee that it is complete, accurate, suitable or up to date for any particular purpose.

  HayInsights is a financial data provider. Nothing on the Services is investment, financial, tax or legal advice, or a recommendation to buy, sell or hold any security or other financial instrument.

  Some countries may restrict the distribution of certain information. You are responsible for understanding and complying with the laws where you live when you use information from the Services, including for investment decisions.

  Past performance, growth or returns shown in charts do not guarantee future results. All investments carry market risk. You are solely responsible for all of your financial and investment decisions, and we recommend that you consult an independent financial adviser before investing.

  Content on the Services is not an offer or solicitation to buy, sell or distribute any financial product in any jurisdiction where that would be unlawful. If you share information from the Services with a third party, both you and the recipient agree to be bound by these Terms.

  The Services may link to third-party websites, such as data sources, news publishers, payment pages or AI assistants. We do not control and are not responsible for the content of those websites. A link does not mean we recommend or endorse the information on them.

  We make reasonable efforts to maintain and improve the Services, but we are not responsible for interruptions, transmission errors, network failures, maintenance, technical faults or events of force majeure.

2. Copyright and intellectual property

  All content created by HayInsights, including text, images, charts, datasets, compilations, audio, video and source code, is owned by or licensed to Finhay Pty Ltd. You may not distribute, modify, copy, transmit, display, reuse, publish, create derivative works from, transfer or sell this content without our prior written consent, except as your subscription plan expressly allows.

  Trademarks, logos, product names and company names of third parties belong to their respective owners. Mentioning them does not mean they endorse, sponsor or recommend HayInsights, or that we endorse them.

  You may not use any trademark shown on the Services, including as a hyperlink, without the prior written consent of HayInsights or the trademark owner.

3. Changes to these Terms and right to suspend or terminate access

  We may change, amend, remove or replace any part of these Terms at any time. We will post the updated Terms on this page with a new "Last updated" date. If you do not agree with the changes, please stop using the Services. If you continue to use the Services after the changes take effect, you accept them.

  We may change the content or features of the Services, or restrict, suspend or refuse access to any user, at any time, including where we reasonably believe a user has breached these Terms. To the extent permitted by law, we are not responsible for any consequences or losses arising from such changes or restrictions.

4. Data security and privacy

  How we collect and use personal data is described in the HayInsights Privacy Policy, which forms part of these Terms.

  We are legally responsible only for information published on HayInsights' official domains. We are not responsible for any loss, damage or data leak arising from links, websites or domains that are not legally managed by HayInsights.

  The Services use cookies to keep you signed in, remember your preferences, analyse traffic and personalise your experience. By continuing to use the Services, you agree to this use. You can refuse cookies in your browser settings, but some features may not work as a result.

  You are responsible for keeping your account credentials and API keys confidential, and for all activity under your account, including requests made by AI assistants you connect to HayInsights.

5. User content and code of conduct

  If you submit content to the Services, such as feedback, comments or data, you are fully responsible for it. We are not responsible for errors, omissions or losses arising from content submitted by other users, and you should treat such content with care, as it may be inaccurate or misleading.

  You may not use the Services to:

    post content that is unlawful, threatening, abusive, harassing, defamatory, obscene, pornographic, racist or otherwise offensive;
  • •
    send unauthorised advertising, spam, chain letters or other unsolicited commercial messages;
  • •
    distribute viruses or any code or program designed to disrupt, damage or limit any system;
  • •
    copy, modify, distribute, commercialise or otherwise use content from the Services without our prior written consent.

  Fair use of data, the API and the MCP server. Your subscription is intended for your own use. To keep the Services reliable for everyone, we ask that you use them within the usage limits of your plan, keep your account and API keys to yourself, and do not redistribute or resell the data you receive. If you need broader access, such as redistribution rights or higher limits, please contact us at hayinsights@finhay.com.vn and we will be glad to discuss it with you.

6. Limitation of liability and indemnity

  To the extent permitted by law, HayInsights, Finhay Pty Ltd, and their directors, employees, affiliates and partners are not liable for any direct, indirect, incidental, special or consequential loss or damage, including loss of profit, revenue or data, or business interruption, arising from:

     accessing, using, being unable to use, or distributing information from the Services;
  2. 2.
     relying on any information, data, chart or analysis on the Services;
  3. 3.
     system errors, transmission failures, or unauthorised access to your account by a third party caused by a security lapse on your side.

  You agree to indemnify, defend and hold harmless HayInsights, Finhay Pty Ltd and their personnel from any claims, lawsuits, losses and costs, including legal fees, arising from your breach of these Terms or your misuse or unlawful use of the Services.
